Article 1 – Definitions

In these Terms and Conditions, the following terms are defined as:

1.1 DateKinky.com ("the Website"): the private limited company MR Tradingservice B.V., trading under the name DateKinky.com, registered with the Chamber of Commerce under number 91945488, located at Vlasveen 28-6, Roden, the Netherlands, VAT number NL865826584B01.

1.2 User: the natural person aged 18 or older who creates an account or uses the Services of the Website.

1.3 Services: all functionalities offered free of charge by the Website, including creating and managing a profile, posting Material, and contacting other Users.

1.4 Material: all content that a User posts on the Website or sends via the Website, including profile texts, photos, and messages.

1.5 Account: the personal registration with which the User gains access to the Services.

1.6 Abuse: any action by the User that violates these terms, applicable laws and regulations, or is harmful to the Website or other Users.

Article 2 – Applicability

2.1 These Terms and Conditions apply to all use of the Website and to all agreements between the Website and the User.

2.2 By creating an Account or using the Website, the User declares to have read, understood, and accepted these terms.

2.3 The Website is entitled to change these terms. Changes take effect thirty (30) days after publication on the Website. If the User does not accept the amended terms, they can terminate their Account.

Article 3 – Free Service

3.1 The Services are provided by the Website free of charge. There are no costs associated with its use for the User.

3.2 The Website is not obliged to continue offering the Services free of charge and may change or terminate the nature, scope, and availability of the Services at any time. If paid functionalities are introduced in the future, separate, previously disclosed terms will apply, to which the User must explicitly agree.

Article 4 – Age Restriction

4.1 The Website is exclusively accessible to persons aged 18 and older. Upon registration, the User confirms that they have reached this age.

4.2 The Website may verify a User's age and may refuse or terminate an Account if there is reasonable doubt about the stated age.

4.3 The Website is not responsible for incorrect information provided by the User.

Article 5 – Account and Registration

5.1 The User is responsible for the accuracy of the data provided during registration and for keeping their login credentials confidential.

5.2 The User is responsible for all actions that occur via their Account and must immediately report suspected abuse to the Website.

5.3 It is not permitted to create multiple Accounts with the intent to circumvent the rules, nor to transfer an Account to third parties.

Article 6 – Rules of Use

6.1 The User shall use the Website exclusively in accordance with these terms and applicable law.

6.2 In particular, the User is not permitted to:

  1. post inflammatory, discriminatory, racist, threatening, or otherwise unlawful material;
  2. post material in which minors are sexually visible or that is otherwise unlawful;
  3. send unsolicited commercial messages (spam);
  4. create false, misleading, or fraudulent profiles;
  5. intimidate, threaten, blackmail, or harass other Users;
  6. collect or disseminate personal data of others without permission;
  7. disrupt the technical operation or security of the Website.

6.3 The Website reserves the right to remove Material and to block or terminate Accounts in case of (suspected) Abuse, without prior warning if necessary.

Article 7 – Material and Intellectual Property

7.1 The User posts Material at their own risk and guarantees that they are entitled to post this Material and that it does not infringe on the rights of third parties.

7.2 The User retains the rights to their own Material but grants the Website a free, non-exclusive license to display and process this Material as necessary for providing the Services.

7.3 The Website is entitled to remove Material that violates these terms or the law.

Article 8 – Privacy

8.1 The Website processes personal data in accordance with the General Data Protection Regulation (GDPR). The manner in which this is done is described in the Privacy Statement on the Website.

8.2 Given the nature of the Website, the Website may process special categories of personal data. By posting such Material, the User gives explicit consent for its processing to the extent necessary for the Services.

Article 9 – Liability and Indemnification

9.1 The Services are offered free of charge and "as is". The Website is not liable for direct or indirect damage resulting from the use of or inability to use the Website, except in cases of intent or willful recklessness on the part of the Website.

9.2 The Website is not responsible for the behavior of Users, the accuracy of profiles, or contacts and meetings that occur via the Website, whether online or offline.

9.3 The User indemnifies the Website against claims from third parties related to Material posted by the User or their use of the Website.

Article 10 – Termination

10.1 The User can delete their Account at any time, free of charge.

10.2 The Website may terminate an Account with immediate effect in case of Abuse or violation of these terms, without being liable for any compensation.

Article 11 – Applicable Law and Disputes

11.1 This agreement is exclusively governed by Dutch law.

11.2 Disputes shall be submitted to the competent court in the district of the Website's registered office, unless mandatory legal provisions dictate otherwise.
